Partial-birth abortion (letter)

by Charles Francis, AM, QC, RFD

News Weekly, July 19, 2008
Sir,

In his review of US Congressman Ron Paul's book The Revolution: A Manifesto (News Weekly, July 5), Jeffry Babb states that partial-birth abortion is protected in the United States by the Supreme Court's 1973 ruling on Roe v. Wade. However, this horrific practice was banned by a substantial majority of the US Congress in the Partial-Birth Abortion Act of 2003.

In 2007, an appeal to the US Supreme Court in Gonzales v. Carhart seeking to quash the ban was defeated by a majority of the court.

Extensive medical evidence was placed before the court, and, in its majority judgment, the court found there never was any medical reason whatever for the performance of this operation.

Sadly, partial-birth abortions are being performed at a clinic in Croydon, Victoria, and in Queensland.

The Victorian Law Reform Commission (VLRC) in its report failed to recommend that it should be banned in Victoria.

Toorak, Vic.
